A prenuptial agreement is a written agreement that is signed by the husband and the wife to be before the marriage and that takes effect upon the marriage. Generally, this type of agreement protects the premarital assets of the parties and can also protect the marital assets and earnings of the parties upon death or divorce. Both parties are required to make full disclosure of their income, assets, and debt and should be represented by their own attorney.
