The point of mediation and collaboration is to avoid the prying eye of the court and retain control over their future. The judge only decides the issues of a divorce if you and your spouse cannot agree on the child-related and economic issues, leading to a court case. The parties sign a Marital Settlement Agreement if they can agree on all of the issues.  If this is the case, the parties must only appear before the judge so that he can grant the divorce.
