What is the Difference Between a TRO and an FRO?

  • The difference between the TRO and FRO is that the TRO is only a temporary order that stays in effect until a hearing is held on whether an FRO should be issued by the court.  
  • If the victim does not show at the hearing by the preponderance of the evidence that there has been an act of domestic violence and that he/she is in fear for their safety, the action with all of the restraints in the TRO is dismissed.
